OVERVIEW

Nearly all construction projects that occur in the Village require a building permit. If you are unsure whether or not your project requires a building permit, please contact us at (815) 877-6072. Home improvements that do not require a permit include: a) siding and window replacements (of the same size); b) kitchen cabinets and countertops; c) carpeting and flooring.

Block Party
Block Party Regulations
The intention and purpose of a block party is to bring together neighbors to socialize, unify and strengthen the relationship and communication of the neighborhood.

Neighborhood block parties are intended for residents only, not the general public. If your neighborhood block party is open to the general public or is being advertised outside the affected area of the block party application may be denied or revoked. Block parties are not intended to be used for the purpose of weddings, birthday parties, holiday parties, retirement parties, etc.

•    Persons seeking to hold a block party must fill out an application and return it to the Public Works Department two (2) weeks prior to the date of the block party.

•    Each block party must designate a person to act as a liaison with the Police Department should any problems arise because of the party.

•    All music and noise must be terminated by 10:00 p.m., 9:00 p.m. Sunday through Thursday.

•    All debris must be cleaned up by the participants at the end of the party.

•    The Public Works Department shall leave barricades at the liaison's home on the day before the block party and shall pick them up from there on the first work day following the party. This person shall be responsible for the set up and take down of the barricades the day of the party as well as be responsible should they become lost, stolen, or broken.

•    At least 75% of the homeowners on the street affected must sign the petition on the application form granting permission for the block party to be held.

•    The block party participants must observe all other Village Ordinances.

•    No alcohol shall be consumed in the street or on any other public property or right-of-way.
 
•    The applicant shall describe all activities expected to occur at the block party upon any portion of the public walk, public parkway, or any other public property. The Department of 

•    Public works and/or the Winnebago County Sheriff's Department shall determine allowable activities.

•    The use of fireworks is strictly prohibited.

•    The block party shall not obstruct the flow of traffic for residents in the area of the block party who do not wish to partake with the party. Emergency equipment and vehicles must have full access to the area affected by the party.

Demolition
All structural demolition conducted in Village limits requires the issuance of a Demolition Permit. The cost of the permit will be determined by the Building Clerk once the permit has been approved. The Village requires gas and electric utilities to be shut off before the demolition process is initiated (copies of shut-off orders must be received by the Building Clerk before permit is issued).

Deck

Any new or expanding deck in the Village of Machesney Park requires a Building Permit and zoning approval to be on file here at Village Hall. If the deck is attached to the house, it has to adhere to traditional zoning setback regulations associated with that property’s zoning classification. If the deck is detached and over 4 ft, it would be considered an Accessory Structure and would have to adhere to our zoning regulations governing accessory structures. Costs will be determined by the Building Clerk once the project has zoning approval. 

A site plan is required with this application, which accurately displays the height of the structure as well as the location of the deck in reference to the house and property lines.

Driveway Construction

Any new driveway construction requires a permit to be on file at Village Hall. Along with a Driveway Construction Permit, an Erosion & Sediment Control Statement needs to be on file as well.

Fence
If you are looking to build or rebuild a fence in the Village of Machesney Park, the Village requires that you fill out a fence permit application. Simply fill out the application and draw a simple site plan that documents the height of the fence as well as where the fence is going to be located in reference to your house and property lines. The Village stipulates that fences are to be no more than 4 ft. high in the front yards of residential lots, and 6 ft. in the side and back yards.

Floodplain Development

There are many areas within the Village that are within the mapped Floodplain. The Federal Emergency Management Agency (FEMA) is responsible for mapping flood-prone areas of the Village, not only along the Rock River, but also along Willow Creek and other unnamed tributaries to the river.  There are several different categories of floodplain, each with different regulations and permitting procedures. Please be aware that there are some areas where construction is prohibited altogether. Please contact the Village’s Floodplain Manager for more information on floodplain regulations and when a Floodplain Development Permit is required for a project.

Garage

Constructing a garage requires a:

  • Building Permit – All proposed garages, whether attached or detached to the residential dwelling, require a Building Permit. Costs will be determined by the Building Clerk once the project has Zoning and Building Approval. If the property is on well and septic instead of public water and sewer, the Winnebago Co. Health Department will need to be called for a quick inspection of the property.

Public Works Construction
Any new construction in the right-of-way requires a permit to be on file at Village Hall with the Public Works Department. Along with the Public Works Construction Permit, an Erosion & Sediment Control Certification Statement needs to be on file as well. If more than 1,000 sq ft is being disturbed, an Erosion Control Permit is required. 

Type of construction subject to a Public Works Construction Permit may include: sidewalk construction, pavement cut, street closure, curb or gutter replacement, or right-of-way work

Roofing

Any roofing or re-roofing projects within the Village require a building permit to be on file at Village Hall.

If you are using a contractor for the project, license must be submitted. Costs will be determined by the Building Clerk once the project has Building Approval.

Shed

Putting up a shed in a residential dwelling requires a:

(1)  Building Permit – If the proposed shed is over 120 sq. ft. in area, a Building Permit needs to be filed. Permit costs will be determined by the Building Clerk once the project has Zoning and Building Approval. If the property is on well and septic instead of public water and sewer, the Winnebago Co. Health Department will need to be called for a quick inspection of the property.

(2)  Shed Permit –  If the shed is no larger than 120 sq. ft in area, only a Shed Permit needs to be completed. A site plan is required with this application, which accurately the location of the shed in reference to the house and property lines.

Signs

Village sign applications for both permanent and temporary signs are reviewed and approved by the Village Administration.

Any new signs constructed within the Village require a:

  • Sign Permit – Costs will be determined by the Building Clerk once the project has Zoning and Building Approval.

Temporary signs, or signs that are designed to be posted on commercially-zoned properties for a specific duration of time require a Temporary Sign Permit on file here at the Village Hall. Commercial Properties are allowed Temporary Business Sign twice (2) a year up to fourteen days (14) at a time, or once a year for twenty-eight (28) consecutive days.

Swimming Pool

Swimming pools are allowed in all residential zoning districts in the Village with the exception of the Rural Residential (RR) classification. For a residential property, a swimming pool is required to be at least 6 ft. from the side and rear yard property lines, and at least 10 ft. from the principal structure or any overhead/underground cables. Winnebago Co. Health Code requires that all swimming pools, “…shall be enclosed within a wall, fence, or hedge, with a maximum height of 8 feet. Such fencing may be an extension of bearing walls of existing structures in the rear yards, but shall not project closer than 6 ft. to the side or rear lot line.” A pool is required to have a fence with a locking gate if it is less than 4 ft. in height, and if it is over 4 ft. it must have a removable or locking ladder. All pools require permanent electrical wiring, and must have a GFCI (Ground Fault Circuit Interrupter) outlet. The electric trenching must be at a minimum of 18 in depth, and must be 6 in apart from the gas line (if applicable).

Above-Ground Pool: An above-ground swimming pool requires a (1) Building Permit and (2) Zoning Approval of a site plan showing the setbacks to the property lines and house. The permit application can be filled out here at Village Hall and is attached below. Please fill out all applicable sections. If your house is on well and septic instead of public water & sewer, approval from the Winnebago Co. Dept. of Public Health must be received as well.

In-Ground Pool: An in-ground swimming pool requires a, (1) Building Permit, (2) Zoning Approval of a site plan showing the setbacks to the property lines and house, (3) Soil & Erosion Application, and (4) Winnebago Co. Health Department Approval (if the property is on well or septic). If the pool is heated, please fill out the supplemental information on the Building Permit Application.
